KSR Defeats $354 Million Tortious Interference Claim

March 2023 – A National Futures Association arbitration panel found in favor of KSR’s client, a nationally recognized futures commission merchant, and denied all claims brought by the claimant, a commodity pool operator. The claimant sought $354,000,000 in damages, alleging that KSR’s client tortiously interfered with its prospective business relations. The week-long arbitration took place in Chicago, during which the claimant’s principal admitted under cross examination that it overstated its purported damages by more than $100 million. The arbitration panel found in favor of KSR’s client and denied the claim with prejudice. Additionally, KSR sought sanctions against the claimant, which the panel granted, awarding KSR’s client sanctions in the form of reimbursement of attorney’s fees.
